Overview

The Firm’s Data Center & Infrastructure Practice group was formed to meet the rapidly growing demand for sophisticated legal counsel in this sector. Our team leverages our deep expertise in real estate, finance, tax, and joint ventures and advises investors, developers, operators, and lenders on all aspects of data center transactions.

We don’t have a crystal ball, but we suspect the exponential growth during the last decade of data centers will continue as the technological demands of our collective industries and sectors grow.  Real estate developers, operators, and investors are seeking locations that address three distinct market structures – server, storage, and network infrastructure. Consequently, data center locations need to be financially profitable, environmentally, climatically, and geographically advantageous, with accessibility to vast amounts of fiber, equipment cooling systems, and electrical, gas, and alternative and renewable energy sources.

As the Pure Play in Real Estate Law, Data Center transactions play to our strengths as they typically encompass some or all of the following legal needs:

  • Land Acquisitions
  • Development Expertise
  • Construction Contracts
  • Land Use and Zoning
  • Real Estate Finance (including construction, term, and mezzanine loans and preferred equity)
  • Joint Ventures
  • Real Estate and Other Governmental and Tax Incentives
  • PACE financing
  • Credit tenant leasing

In addition to our legal expertise, the Firm also offers vaunted business assistance through its initiative to Help Our Clients Grow Their Businesses. Applied to Data Centers, this consists of sourcing transactions (for our clients seeking to deploy capital) and capital (for our clients seeking this capital).
